These Terms of Service ("Terms") govern your access to and use of the AMG Wellness website located at amgwellness.net and all related services, products, and wellness protocols offered by AMG Wellness ("AMG Wellness," "we," "us," or "our"). By accessing our website or purchasing any service, you agree to be bound by these Terms. If you do not agree, please do not use our services.
These Terms should be read in conjunction with our Privacy Policy and Disclaimer, which are incorporated herein by reference.
1. Eligibility
Our services are available to individuals who are 18 years of age or older and legally capable of entering into binding contracts. By using our services, you represent and warrant that you meet these requirements. We reserve the right to refuse service to anyone for any reason at any time.
2. Medical Services and Clinical Protocols
AMG Wellness provides medically supervised wellness services, including body contouring, InBody 380 body composition analysis, and peptide/GLP-1 therapy protocols. All clinical services are provided under the supervision of licensed healthcare providers. Nothing on this website constitutes medical advice, diagnosis, or treatment. You should always consult a qualified healthcare professional before beginning any wellness protocol.
A Good Faith Exam conducted by a licensed prescriber is required prior to the initiation of any prescription peptide or GLP-1 therapy. This exam establishes a valid prescriber-patient relationship as required by applicable state and federal law.
3. GLP-1 Medications — Compounding Pharmacy Fulfillment
Important Notice Regarding GLP-1 Medication Subscriptions
All subscriptions for GLP-1 medications (including but not limited to semaglutide, tirzepatide, and related compounds) offered through AMG Wellness are fulfilled exclusively by a licensed compounding pharmacy. AMG Wellness does not manufacture, dispense, or ship medications directly. Medications are compounded, dispensed, and shipped directly to you by our partnered compounding pharmacy(ies) operating under applicable state pharmacy board licensure and federal law.
By subscribing to a GLP-1 medication protocol, you acknowledge and agree that:
- Your prescription will be reviewed and issued by a licensed prescriber following a Good Faith Exam;
- Your medication will be compounded and shipped by a licensed compounding pharmacy, not by AMG Wellness;
- Compounded medications are not FDA-approved drug products; they are prepared pursuant to a valid prescription for an individual patient;
- Shipping timelines, packaging, and labeling are managed by the compounding pharmacy and may vary;
- You are responsible for providing accurate shipping and health information to facilitate safe and lawful dispensing;
- Subscription billing is managed by AMG Wellness; medication fulfillment is managed by the compounding pharmacy.
4. Peptide Therapy — Regulatory Status and Compounding Authorization
FDA Regulatory Status of Peptide Compounds
Certain peptides offered through AMG Wellness protocols are not independently FDA-approved drug products; however, they are FDA-cleared for compounding by licensed compounding pharmacies under the following regulatory frameworks:
- Category 1 — 503A Compounding (Patient-Specific): Peptides compounded by a licensed 503A compounding pharmacy pursuant to a valid, patient-specific prescription from a licensed prescriber. These compounds are prepared in accordance with USP standards and applicable state pharmacy law. 503A pharmacies may compound peptides that appear on the FDA's list of bulk drug substances that may be used in compounding under 21 U.S.C. § 353a.
- Category 2 — 503B Outsourcing Facility: Certain peptides may be sourced from FDA-registered 503B outsourcing facilities, which are subject to current Good Manufacturing Practice (cGMP) requirements and FDA oversight. 503B facilities may produce compounded drugs without patient-specific prescriptions for office use by licensed practitioners.
By participating in a peptide therapy protocol, you acknowledge that:
- The peptides prescribed are compounded preparations, not commercially manufactured FDA-approved drugs;
- Compounding is performed by licensed pharmacies operating under applicable federal and state law;
- The safety and efficacy of compounded peptides have not been evaluated by the FDA in the same manner as approved drugs;
- You have been informed of the regulatory status of your prescribed compounds and consent to their use;
- AMG Wellness does not make any representations that compounded peptides are equivalent to FDA-approved drug products.
5. Memberships and Subscriptions
AMG Wellness offers monthly membership plans (Foundation, Performance, and Elite) that provide access to specified services and protocols. By enrolling in a membership:
- You authorize AMG Wellness to charge your payment method on a recurring monthly basis at the rate applicable to your selected tier;
- Memberships automatically renew each month unless cancelled at least 5 business days prior to your next billing date;
- Membership fees are non-refundable except as required by applicable law or as expressly stated in our refund policy;
- AMG Wellness reserves the right to modify membership pricing with 30 days' written notice;
- Membership benefits are non-transferable and for individual use only;
- Membership does not include the cost of prescription medications, which are billed separately through the compounding pharmacy.
6. Cancellation and Refund Policy
Membership Cancellations: You may cancel your membership at any time by contacting us at [email protected] or (346) 550-9228. Cancellations must be received at least 5 business days before your next billing cycle to avoid the next charge.
Session Packages: Purchased session packages are non-refundable once services have been rendered. Unused sessions in a package may be used within 12 months of purchase.
Medication Subscriptions: Refunds for compounded medications are subject to the policies of the fulfilling compounding pharmacy. Once a prescription has been compounded and shipped, it generally cannot be returned or refunded due to safety and regulatory requirements.
Body Contouring Sessions: Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee.
7. Payment Processing
Payments for AMG Wellness services are processed through Stripe, a third-party payment processor. By providing your payment information, you authorize AMG Wellness and Stripe to charge your payment method for services rendered. Your payment information is encrypted and processed in accordance with PCI-DSS standards. AMG Wellness does not store your full credit card number on our servers.
8. Assumption of Risk and Medical Clearance
Participation in any AMG Wellness protocol, including body contouring, peptide therapy, and GLP-1 programs, involves inherent risks. You represent that you have disclosed all relevant medical history to your prescribing provider and that you have received appropriate medical clearance. You voluntarily assume all risks associated with your participation in AMG Wellness protocols.
AMG Wellness strongly recommends that you consult with your primary care physician or specialist before beginning any new wellness protocol, particularly if you have pre-existing medical conditions, are pregnant or nursing, or are taking prescription medications.
9. Limitation of Liability
To the fullest extent permitted by applicable law, AMG Wellness, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to personal injury, property damage, loss of data, or loss of revenue.
Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid to AMG Wellness in the 12 months preceding the claim.
10. Intellectual Property
All content on the AMG Wellness website, including text, graphics, logos, images, and software, is the property of AMG Wellness or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Montgomery County, Texas. You consent to the personal jurisdiction of such courts.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of our services after any modification constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically.
